SAG-AFTRA files complaint against Epic Games over AI use

SAG-AFTRA, the union representing professionals in film, television, and interactive media, has filed an Unfair Labor Practice (ULP) complaint against Epic Games. The accusation pertains to the use of an AI-generated version of Darth Vader's voice in the new season of Fortnite.

What's at stake?

The central issue revolves around the fact that SAG-AFTRA is on strike while negotiating a new contract with video game companies. The use of the AI voice, according to the union, represents Epic's refusal to "negotiate in good faith." Although the version of Darth Vader in the game is interactive, it is important to note that other actors have also portrayed the character who were not exclusively James Earl Jones.

History of AI voice use

Disney obtained permission from James Earl Jones and his family to use AI to replicate his voice in movies and TV shows in 2022. Jones’ death in September 2024 made the approach of AI the only alternative to using his "original voice," except for reusing clips from past performances. If Epic or Disney choose to hire another actor for the role, it will require a new contract with the video game performers.

Consequences of SAG-AFTRA's complaints

ULP complaints are reviewed by the National Labor Relations Board and may result in hearings and temporary relief, such as removing Darth Vader from the game until a settlement is reached. Additionally, these complaints are often a strategy used by unions to pressure companies to return to the bargaining table. SAG-AFTRA's strike in the interactive media sector began on July 26, 2024, motivated by a favorable vote from members in September 2023 for better wages and protection against the use of AI.
